Serious Personal Injury Litigation Cases

Personal injury cases may involve minor to serious injuries, and wrongful death.  However, when it comes to your life or that of a loved one, nothing is minor.

We can advise you about your rights and the best steps to take after a serious personal injury.  If you have a personal injury claim, Burns & Schultz can help you get fair compensation for medical treatment, lost wages, and pain and suffering.

Burns & Schultz handles all types of personal injury cases, including the following:

  • Negligence.  If you have been injured as a result of another person’s negligence or fault, you may be entitled to monetary damages to compensate you for bodily injury, property damage, emotional distress, and lost wages.
  • Wrongful death.  When the unthinkable happens and someone you love has died because of another person’s negligence or fault, you may be entitled to financial compensation to compensate for your loss.  Under New York’s Wrongful Death statute, monetary damages may be awarded to the survivors and beneficiaries for loss of companionship, loss income of the person who died, loss of services, care, and assistance, and the medical expenses of the person who died if related to the injury resulting in death.
  • Automobile accidents.  Traffic accidents are the most common type of personal injury case.  If you or a loved one is injured in a car accident, you should contact an attorney soon after the accident.  Under New York law, when a driver or passenger is injured, the vehicle owner's insurance company pays for their medical bills and lost wages.  However, to qualify for No-Fault benefits, you must give notice to the insurance company within 30 days of the accident.  To be eligible to sue for personal injuries, there must be a “serious injury.”
  • Construction accidents.  Accidents on construction sites are common.  New York law provides for special protection for workers who are injured on construction sites.

At Burns & Schultz LLP, we provide big-firm experience and capability with small firm personal attention and service.

To discuss our representation of you in a personal injury matter, contact Andrew Burns or Jill Schultz at 585.672.2600 or by email at aburns@burnsandschultz.com or jschultz@burnsandschultz.com.

For personal injury cases, we offer a free consultation to determine if your case can be taken on a contingency fee basis.  If we accept your case, you will not pay for our legal services until there is a recovery.
